Client Expansion

We were introduced to Wild Nutrition by another client, Lab Brands Limited (formerly Prontaguerra Ltd), in 2017. Wild Nutrition had been established for four years and they had existing trade mark registrations in the United Kingdom, the European Union and Norway. They were looking to expand by distributing their products in overseas markets. They wanted trade mark protection in Australia, Hong Kong, Singapore and China. They wanted their trade mark protection to cover the nutritional supplements that they create and sell, any goods that they might sell in the future via veterinary clinics, nutritional clinic services they were just launching and biotechnology research and development processes they use to develop the nutrients within their products.

How we helped

We filed trade mark applications in Australia for the WILD NUTRITION word mark, the FOOD-GROWN word mark and the WN logo, in 2 classes each for supplements and advisory services.

The FOOD-GROWN word mark and the WN logo moved through the trade mark application process without issue and both trade marks were registered within the shortest possible time-frame, just over seven months later.

The Trade Marks Examiner, who assesses trade mark applications, raised issues with the WILD NUTRITION word mark. We prepared and submitted submissions supporting the registration of the trade mark and collated and prepared evidence of use of the trade mark.

We ultimately negotiated with a third party and their representatives to obtain consent to registration of the WILD NUTRITION word mark. This process took just over three years and the trade mark was registered in September 2020.

We also filed corresponding international trade mark applications in Singapore, China and Hong Kong. In Singapore, the trade mark applications moved through the process without issue and were registered 10 months later. In China and Hong Kong we consulted amongst our network of international trade mark agents to obtain territory-specific advice. We worked together with our agent in Hong Kong to obtain registration of all three trade marks. We worked together with our agent in China to ultimately obtain trade marks in Chinese characters for the client.
