Lab Brands Limited (formerly Prontaguerra Ltd) is a haircare company founded in 2012 in the United Kingdom. The company’s ethos is to apply traditional skincare regimes to look after hair health, based on their motto: healthy scalp = healthy hair. Lab Brands Limited’s signature ingredient is prickly pear oil, that is grown exclusively for the company on the high grassland plains of South Africa. Prickly pear oil has at least two times the potency of argan oil and Moroccan oil.

Client Project
A founder of Lab Brands Limited approached me in 2015 when embarking on a new business venture. He and his business partners had bought a haircare brand in London, in which they saw great potential in some aspects, and attention required on other aspects. They were impressed by the key ingredient, prickly pear oil, and were excited to refine its product range.
He gave me their four shortlisted trade marks and asked me to conduct searches and provide comparative advice and comments on the availability and registrability of those trade marks in the key territories of interest.
How we helped
During the first part of my role, I provided the client’s requested advice and comments relating to the four short-listed trade marks. In the interim, the client became wedded to the LONDON LABS. SKINCARE FOR HAIR trade mark. Against my advice, the client chose to pursue that trade mark.
I filed a trade mark application in Australia for LONDON LABS. SKINCARE FOR HAIR in 3 classes, for haircare products, brushes and retail services.
The Trade Marks Examiner, who assesses trade mark applications, raised the issues that I foresaw with this trade mark application in Australia. The trade mark application became contentious and I therefore referred it to former colleagues and worked with them to overcome the issues. The process required collating and submitting evidence of use and moving through reciprocal opposition proceedings. We obtained the trade mark registration for LONDON LABS. SKINCARE FOR HAIR about two and a half years later.
We filed corresponding international trade mark applications in the territories listed under the Territories heading above. In some territories, the trade marks moved through the application process without issue and in other territories, we consulted amongst our network of trade marks agents and worked with them to obtain registrations of the LONDON LABS. SKINCARE FOR HAIR trade mark globally.
