Client Issue
The Founder and Director of Method Planning sought our advice in 2023. A friend had alerted him that a very similar logo to the METHOD PLANNING icon was being used by another business. This was of particular concern as Method Planning had recently completed a comprehensive branding project, during which the new logo had been developed.
How we helped
We identified the user as a Singapore-based company and promptly conducted rudimentary international trade mark searches to assess the extent of potential risk to Method Planning’s business.
We needed to enable Method Planning to prevent or attack another party using the same or a similar trademark and to limit Method Planning’s risk of exposure to potentially costly and draining formal issues with other parties.
We filed a trade mark application in Australia for the METHOD PLANNING icon in 1 class for Method Planning’s services in town planning, urban planning, project management and related services.
The trade mark application progressed through IP Australia’s trade mark application process without issue and we obtained a trade mark registration for the METHOD PLANNING icon within the shortest time-frame possible, just over seven months later.
Outcome
With the trade mark registered, the team at Method Planning have the monopoly trade mark rights in place, which is crucial to prevent other parties from using a similar logo to theirs.
